1. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using the ChatAIBuddy mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
2. PARTIES
These Terms are entered into between you ("User" or "you") and Murat Buz ("Company", "we", "us", or "our"), the owner and operator of ChatAIBuddy.

3. DESCRIPTION OF SERVICE
ChatAIBuddy is an AI-powered chat companion application that provides emotional support and conversation services. The App is designed for users aged 13 and above. The App does not provide medical diagnosis, treatment, or professional therapy services.
4. IMPORTANT DISCLAIMERS
4.1. NOT A MEDICAL SERVICE
The App is NOT a substitute for professional medical, psychiatric, or psychological care. The App does not provide medical diagnosis, treatment, or clinical decision support. If you are experiencing a medical emergency, suicidal thoughts, or thoughts of harming yourself or others, please contact emergency services (e.g., 112) or your nearest healthcare facility immediately.
4.2. AI-GENERATED CONTENT
All responses and content provided by the App are generated by artificial intelligence and are for informational and support purposes only. You acknowledge that AI-generated content may contain errors or inaccuracies and should not be used as the sole basis for making important personal, medical, or legal decisions.
4.3. USER RESPONSIBILITY
You are solely responsible for your use of the App and any decisions or actions you take based on information provided by the App. The Company is not liable for any consequences resulting from your use of the App.
5. AGE RESTRICTIONS
The App is intended for users who are 13 years of age or older. Users under 13 are prohibited from using the App. Users between 13 and 18 years of age must have parental or guardian consent as required by applicable local laws.
6. USER ACCOUNT AND REGISTRATION
6.1. Account Creation
To use certain features of the App, you must create an account by providing accurate, current, and complete information, including your name, email address, and date of birth.
6.2. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
6.3. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason we deem necessary.
7. SUBSCRIPTIONS AND PAYMENTS
7.1. Subscription Plans
ChatAIBuddy offers auto-renewing subscription plans (weekly and monthly) that provide unlimited messaging. Subscription prices are displayed in the App and may vary by region.
7.2. Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You can manage and cancel your subscription through your Apple App Store or Google Play Store account settings.
7.3. Payment Processing
All payments are processed through Apple App Store or Google Play Store. We do not process, store, or have access to your payment information. Payment disputes and refunds are handled according to the respective platform's policies.
7.4. Price Changes
We reserve the right to change subscription prices at any time. Price changes will be communicated through the App or via email. Continued use of the App after a price change constitutes acceptance of the new price.
7.5. Refunds
Refund requests must be submitted through the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.
8. FREE TRIAL AND MESSAGE LIMITS
8.1. Free Messages
New users receive a limited number of free messages. Once the free message limit is reached, a subscription is required to continue using the App.
8.2. Subscription Benefits
Subscribers receive unlimited messages during their active subscription period.
9. USER CONDUCT
9.1. Prohibited Activities
You agree not to:
- Use the App for any illegal or unauthorized purpose
- Violate any laws or regulations
- Infringe upon the rights of others
- Transmit harmful, offensive, or inappropriate content
- Attempt to reverse engineer, decompile, or disassemble the App
- Use automated systems or bots to interact with the App
- Share your account credentials with others
- Use the App to harass, abuse, or harm others
9.2. Content Responsibility
You are solely responsible for all content you submit or transmit through the App. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.
10. INTELLECTUAL PROPERTY
10.1. App Ownership
The App, including all content, features, functionality, and intellectual property rights, is owned by the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws.
10.2. Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.
10.3. Restrictions
You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
11. PRIVACY
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.
12. TERMINATION
12.1. Termination by You
You may stop using the App at any time by deleting the App from your device and cancelling any active subscriptions through your App Store or Play Store account.
12.2. Termination by Us
We may terminate or suspend your access to the App immediately, without prior notice, for any breach of these Terms or for any other reason we deem necessary.
12.3. Effect of Termination
Upon termination, your right to use the App will cease immediately. We are not obligated to provide refunds for any unused portion of your subscription.
13. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
14. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
15. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.
16. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or by sending you an email. Your continued use of the App after such changes constitutes your acceptance of the modified Terms.
17. GOVERNING LAW AND DISPUTE RESOLUTION
17.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
17.2. Consumer Rights
If you are a consumer under Turkish law, you have the right to file complaints with consumer arbitration committees or consumer courts in your place of residence or where the transaction occurred.
17.3. Non-Consumer Disputes
For non-consumer users, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
18. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the App and supersede all prior agreements and understandings.
